Maintaining our authority over public roadways

We’re writing to inform you about an important new law, Statute ARS 22-1818, which affects how we manage public roads in our neighborhood. Since our community rules were established before January 1, 2025, this law will have a direct impact on us.

Our current rules regarding the use of public roads will remain in effect until June 30, 2025, at which point the developer’s control ends. By that date, we are required to hold a community meeting where homeowners will vote on whether to continue regulating our public roads. For this vote to be valid, a quorum must be present at the meeting, and a majority of homeowners need to vote in favor of keeping our regulations. If the vote passes, we will record the decision with the county, allowing us to maintain control over our public roads. However, if the vote fails or no vote takes place, we will lose this authority, and our current rules will expire.

It’s important that we continue regulating our public roads for several reasons. Without these regulations, larger vehicles like RVs, boats, semi-trucks, portable bathrooms, and storage pods could be parked on our streets, creating safety hazards and negatively affecting the appearance of the neighborhood. Additionally, ensuring that emergency vehicles can easily access our streets is essential for the safety of everyone. Regulating traffic also helps protect children and contributes to the overall look and feel of our community.
